Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Smart Auto Tagging Shopify application and the Order Status Automator BigCommerce application (collectively, the “Apps”), provided by Technicko (“we”, “us”, or “our”). By installing or using either App, you agree to be bound by these Terms.
1. Use of the Apps
You may use the Apps solely for your internal business operations and in accordance with these Terms. You are responsible for ensuring that your use of the Apps complies with all applicable laws, regulations, and platform policies (including Shopify's and BigCommerce's Partner Program Agreements).
2. Configuration and Merchant Responsibility
The Apps provide automation tools that execute actions based on rules configured by you. You acknowledge and agree that:
- You are solely responsible for configuring the Apps correctly.
- You are responsible for reviewing and testing your rules before enabling them.
- You are responsible for monitoring the outcomes of your automations.
We are not responsible for any consequences arising from incorrect configuration, unintended rule logic, or misuse of the Apps.
3. No Warranty / As-Is Basis
The Apps are provided on an “as-is” and “as-available” basis. We make no warranties, express or implied, including but not limited to accuracy, reliability, error-free operation, uninterrupted availability, or suitability for a particular purpose. You use the Apps at your own risk.
4. Third-Party Platforms and Dependencies
The Apps rely on third-party systems including Shopify APIs, BigCommerce APIs, webhooks, and other integrations. We are not responsible for outages, delays, data inaccuracies, API changes, or failures caused by third-party services.
5. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including any loss of revenue, profits, data, orders, customers, goodwill, or business opportunities.
Our total aggregate liability for any claim shall not exceed the fees actually paid by you for the applicable App in the one (1) month immediately preceding the event giving rise to the claim. If you are on a free plan, our total liability shall be zero dollars (AUD $0).
6. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, or expenses arising out of: (a) your use or misuse of the Apps; (b) your configuration of automation rules; (c) your violation of these Terms; or (d) your violation of applicable laws or third-party rights.
7. Data Handling
The Apps access and process store data solely for the purpose of providing their functionality. We do not sell, share, or disclose your data except as required to operate the Apps or comply with legal obligations. Please refer to our Privacy Policy for full details.
8. Termination
We may suspend or terminate your access to the Apps at any time if you violate these Terms, misuse the Apps, or if platform policies require removal. You may uninstall the Apps at any time. Uninstalling immediately terminates your license and does not entitle you to any refund of fees already paid.
9. Modifications
We may update these Terms at any time. Continued use of the Apps after changes are posted constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of Australia, without regard to conflict-of-law principles.
